The U.S. International Trade Commission (ITC) issued an exclusion order banning imports of infringing diamond drill bit components after finding that several foreign companies violated Section 337 of the Tariff Act. The order protects Finnegan client US Synthetic Corp., a leading developer of polycrystalline diamond cutters for oil and gas exploration.
The ITC investigation began in 2020 when US Synthetic alleged infringement of several patents. Although the ITC initially ruled one of the patents invalid under the Supreme Court’s Alice framework, the Federal Circuit later revived the patent, confirming it as a valid composition of matter. With the patent reinstated, the ITC imposed exclusion and cease-and-desist orders against SF Diamond, Iljin Diamond, Henan Jingrui, and others, blocking infringing imports and safeguarding US Synthetic’s technology.
