Law360's Legal Lions of the Week: Volkswagen Group of America, Inc.

Finnegan was recognized in Law360’s Legal Lions of the Week for successfully representing its client Volkswagen Group of America, Inc. The Federal Circuit ruled that patent owners seeking damages before filing a lawsuit must meet patent-marking requirements, even if their licensees believe their products do not infringe.

The court also upheld the dismissal of VDPP LLC’s lawsuit against Volkswagen, finding there was no evidence Volkswagen knew it was allegedly infringing the 3D glasses patent. VDPP did not contact Volkswagen about the alleged infringement before filing suit.
