James Barney, managing partner of Finnegan, is a nationally recognized patent litigator and appellate advocate who delivers strategic, business-focused counsel to global companies navigating high-stakes intellectual property disputes. With a proven track record as lead counsel in complex litigation and appeals, James has represented clients across a broad spectrum of industries, including those in the automotive, medical devices, chemicals, consumer electronics, financial services, and entertainment spaces, before U.S. district courts, the U.S. International Trade Commission (ITC), and the U.S. Court of Appeals for the Federal Circuit.
Named an “Intellectual Property MVP” by Law360, James is known for his command of both the technical and legal dimensions of patent litigation. He has successfully argued claim construction and dispositive motions, led trial teams through opening and closing arguments and expert and fact witness examinations, and managed litigation strategy from pre-suit investigation through appeal. His experience extends to jury trials, bench trials, agency proceedings, arbitrations, and alternative dispute resolution (ADR) proceedings, making him a versatile advocate in any forum. He has also assisted with patent litigations in Europe and Asia.
James advises multinational clients on patent portfolio strategy, licensing, and risk mitigation. He regularly provides opinions of counsel and helps clients resolve disputes efficiently while often avoiding litigation altogether. His leadership experience includes serving on the firm’s management committee and leading its appellate practice.
A sought-after speaker and educator, James lectures frequently in the U.S. and internationally on patent litigation and appellate advocacy. He is consistently recognized as a “Patent Star” by Managing Intellectual Property (MIP) and is ranked by Intellectual Asset Management (IAM) Patent 1000, among others in Washington, DC, for his IP litigation work.
James is deeply committed to pro bono service, particularly representing military veterans in appeals before the Federal Circuit and the U.S. Supreme Court. James is a graduate of the U.S. Naval Academy and served as an officer in the U.S. Navy before attending Yale Law School. His contributions have earned him recognition on the Capital Pro Bono Honor Roll.

In Re Certain Polycrystalline Diamond Compacts and Articles Containing Same
Secured a decisive victory for client US Synthetic Corp. (USS) at the ITC. After a full hearing, the ALJ found that respondents infringed multiple claims of USS’s patent and that the claims were valid and supported by a domestic industry, but an initial Commission ruling under § 101 temporarily prevented a finding of violation of Section 337. The Federal Circuit reversed the § 101 ruling, and on remand the ITC found a violation and issued a limited exclusion order barring infringing polycrystalline diamond products from entry into the United States, securing final relief for USS.
