The U.S. Court of Appeals for the Federal Circuit affirmed the dismissal of a patent infringement lawsuit brought by VDPP LLC against Finnegan client Volkswagen Group of America, Inc. and upheld more than $200,000 in attorneys’ fees awarded to Volkswagen. The court found that VDPP filed an amended complaint after agreeing not to do so and agreed that the proposed amendment would not have addressed deficiencies in the case.
The court also agreed with the district court’s finding that the case was exceptional, citing several arguments and positions advanced by VDPP that it found unreasonable. In addition, the Federal Circuit upheld the fee award to Volkswagen and dismissed an appeal challenging sanctions imposed on VDPP’s attorney for procedural reasons.
