WASHINGTON, DC—Finnegan client Xiamen PVTECH Corporation (“PVTECH”) announced today that the United States Patent and Trademark Office (USPTO) has denied a request by Jiaxing Super Lighting Electric Appliance Co., Ltd. (“Super Lighting”) for ex parte reexamination (EPR) of U.S. Patent No. 10,645,784, which PVTECH is asserting against Super Lighting in pending litigation in the U.S. District Court for the Eastern District of Texas. The reexamination proceeding was assigned U.S. Control No. 90/016,404.
The USPTO determined that Super Lighting’s EPR request failed to raise a substantial new question of patentability and therefore declined to order reexamination. The decision followed PVTECH’s submission of a pre-order paper under the USPTO’s new April 2026 procedure, which allows patent owners to address whether a reexamination request presents a substantial new question of patentability before the Office determines whether to institute reexamination. The decision appears to be among the first denials issued following consideration of a patent owner’s pre-order submission under the new procedure.
PVTECH filed its lawsuit against Super Lighting in December 2025, alleging willful infringement of ten U.S. patents relating to LED tube technology. The case is pending in the U.S. District Court for the Eastern District of Texas, Case No. 2:25-cv-01204. PVTECH has consistently maintained that its asserted patents are valid and infringed.
“This is an important early result under the USPTO’s new procedure,” said Lionel Lavenue, Finnegan partner and lead counsel for PVTECH. “The pre-order process gave PVTECH an opportunity to explain at the outset why Super Lighting’s request failed to raise a substantial new question of patentability. The USPTO agreed and declined to order reexamination. We will continue to vigorously defend PVTECH’s patent rights before the USPTO and enforce those rights in the Eastern District of Texas.”
PVTECH will continue to pursue its infringement claims against Super Lighting in the Eastern District of Texas.
