WASHINGTON, DC-Finnegan has achieved a major victory for Innoscience, a global leader in gallium nitride (GaN) power devices, in a high-profile patent dispute before the U.S. International Trade Commission (ITC). The ITC Administrative Law Judge’s (ALJ) initial determination confirmed that Innoscience avoided all patent claims asserted by Infineon—completely thwarting Infineon’s litigation efforts.
Infineon filed its ITC complaint in July 2024, alleging infringement of four U.S. patents (Investigation No. 337-TA-1414). Within days of being retained, Finnegan deployed a comprehensive defense strategy—challenging the asserted patents on non-infringement and invalidity grounds while simultaneously guiding Innoscience through a rapid design-around process to launch redesigned products that fully circumvent Infineon’s patents.
Before trial, Infineon withdrew its claims on two of the four patents. Innoscience then requested the ALJ to adjudicate the remaining two patents as applied to both its legacy and redesigned products. Infineon opposed, asking the ALJ to exclude the redesigned products from consideration.
In the initial ruling issued December 2, 2025, the ALJ found no violation of one of the two remaining patents. Although the ITC’s one-page Notice referenced infringement of the other remaining patent, the ALJ’s full decision concluded that Innoscience met its burden for adjudication of the redesigned products and ruled that they fall outside the scope of both patents. This decision effectively ensures Innoscience’s ability to sell products that have been found to avoid all remaining patent claims.
“This is a textbook ITC win for respondents,” said Finnegan partner Lionel Lavenue. “Infineon launched this four-patent lawsuit hoping to derail Innoscience’s technology and market advancement. Instead, Innoscience emerged completely unscathed and continues its business without limitation.”
