Luke MacDonald, Ph.D. has a diverse intellectual property practice that includes district court patent litigation, patent prosecution, appeals at the U.S. Court of Appeals for the Federal Circuit, and proceedings before the Patent Trial and Appeal Board (PTAB) and the Trademark Trial and Appeal Board (TTAB). Luke represents clients across a range of technologies in the electrical sciences, financial services, communications industry, automotive industry, biomedical field, environmental sector, retail, and more.

Luke has substantial experience in various phases of litigation including motions practice, briefing, managing discovery, depositions, assisting technical experts, petitions for inter partes review (IPRs), appeals, and other strategic phases of litigation. He also develops invalidity and infringement positions for clients seeking to launch new products.

Luke has extensive patent prosecution experience ranging from managing large international patent portfolios to developing patent strategies for early-stage startup companies. He works with teams of attorneys at Finnegan to implement portfolio development strategies. Since joining Finnegan full time during law school, Luke has prosecuted over 200 patent applications. Luke helps clients succeed when dealing with complex issues on subject matter eligibility and crowded fields of prior art.

Luke has a wide range of technical expertise spanning biomedical physics, mathematics, microbiology, computer programming, environmental engineering, and public health. Prior to joining Finnegan, he worked as a faculty scientist at the Johns Hopkins Bloomberg School of Public Health and as the deputy director of the Johns Hopkins Water Institute. Luke developed and oversaw national scale mobile technology-based health monitoring programs in Asia, Africa, and Latin America. At Princeton, Luke's graduate dissertation research focused on biogeochemical reactions in the environment and their influence on contaminant transport. He was awarded numerous competitive research grants. During his time in academia, Luke was an invited speaker at multiple conferences and panels around the United States.

Luke has been recognized on the Capital Pro Bono Honor Roll.

In the Matter of Certain Semiconductor Devices and Products Containing the Same

Achieved a comprehensive victory for respondent Innoscience, a global leader in gallium nitride (GaN) power devices, in a high-profile patent dispute before the U.S. International Trade Commission (ITC). The ITC’s Final Determination confirms that Innoscience avoided all patent claims asserted by Infineon.

Bell Northern Research, LLC v. MediaTek Inc. et al.

Obtained favorable settlement prior to trial at the U.S. International Trade Commission (ITC) after obtaining a finding of indefiniteness of one of three asserted patents, institution of inter partes review (IPR) of another patent, and filing an offensive case seeking damages, inter alia, in the form of attorneys’ fees for being forced to defend against Bell Northern’s assertion of patents in violation of FRAND licensing obligations.

Successfully represented DJI in a patent litigation involving drone technology and succeeded in getting the entirety of plaintiff’s damages expert’s report excluded under Daubert on the eve of trial, driving a favorable resolution.

Shure Incorporated et al. v. ClearOne, Inc.

Represented plaintiff Shure Incorporated and Shure Acquisition Holdings, Inc. involving utility and design patents and false claims related to ceiling microphone array products. The design patent trial concluded in November 2021 and the case later settled favorably.
