Finnegan client BMW received a win from the Eastern District of Texas when a federal judge ruled that Arigna Technology failed to establish enough of a connection with the jurisdiction to keep the suit alive in that venue. Arigna targeted BMW’s Munich-based brand and its U.S. subsidiary, alleging that they infringed on one of Arigna’s microchip patents. The company argued that independent BMW dealers in the state could be considered agents for BMW, but the judge disagreed.
Finnegan partner Lionel Lavenue represented BMW. He said he was pleased with the order because it "confirms venue is improper for BMW [North America] based on third-party dealerships."
