Matthew (Matt) C. Berntsen is an intellectual property (IP) litigator with extensive experience representing individuals and companies of all sizes, particularly in complex patent disputes.

Matt has successfully litigated cases involving a wide range of subject matter, including computer- and Internet-based technologies; wireless and optical data transmission; light-emitting diodes (LEDs); semiconductor lithography; industrial automation; pharmaceuticals; and sporting equipment. He represents clients before federal district courts and the U.S. International Trade Commission (ITC), as well as at the U.S. Court of Appeals for the Federal Circuit. Matt also architects proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO). He has been recognized by The Legal 500 U.S. for his work in IP.

 

Beyond his experience with utility patents, Matt has led teams in achieving successful outcomes for matters involving design patents, copyright infringement and the Digital Millennium Copyright Act (DMCA), trade secret misappropriation, and state unfair business law violations.

 

Matt maintains an active pro bono practice fighting for civil rights and disadvantaged individuals.

 

 

Experience

Stragent, LLC v. BMW et al.

Obtained a royalty-free license to Stragent’s entire patent portfolio after forcing Stragent to concede in open court that it could not present enough evidence to prove infringement of its asserted patents, which Stragent read on the automotive communications standard AUTOSAR. Successfully invalidated multiple of Stragent’s patents before the Patent Office, with one victory on appeal and additional IPR petitions pending at the time of case resolution.

Scramoge Technology Limited v. Volkswagen AG, et al.

Won four-patent case for client Volkswagen involving wireless charging technology. After getting the case stayed pending inter partes review (IPR) proceedings involving all four patents, Volkswagen secured a full settlement and dismissal with prejudice without making any payment to Scramoge.

In the Matter of Certain Power Inverters and Converters, Vehicles Containing the Same, and Components Thereof

BMW of North America, LLC and Bayerische Motoren Werke AG (collectively, “BMW”) earned a final determination rebuffing an International Trade Commission (ITC) complaint by Arigna Technology Limited (“Arigna”) aiming to ban the importation and sale of certain of BMW’s innovative mild-hybrid, hybrid, and all-electric SUVs and other vehicles.

NXP USA Inc. v. MediaTek, Inc. et al.

Represented defendants MediaTek Inc. and MediaTek USA Inc. in a standard essential patent (SEP) suit relating to WiFi semiconductors. The case was successfully settled.

In the Matter of Certain Semiconductor Devices and Products Containing the Same

Achieved a comprehensive victory for respondent Innoscience, a global leader in gallium nitride (GaN) power devices, in a high-profile patent dispute before the U.S. International Trade Commission (ITC). The ITC’s Final Determination confirms that Innoscience avoided all patent claims asserted by Infineon.
