WASHINGTON, DC–Finnegan is pleased to announce that the firm has achieved a massive victory for firm client Innoscience before U.S. Customs and Border Protection (CBP), securing a ruling confirming that Innoscience’s new generation gallium nitride (GaN) power products are not subject to the Limited Exclusion Order (LEO) issued by the U.S. International Trade Commission (ITC) in Investigation No. 337‑TA‑1366.
The CBP ruling, issued on February 20, 2026, confirms that Innoscience may make, use, sell, offer for sale, and import its new generation products into the United States without restriction, restoring full access to the U.S. market.
This ruling marks the third major win Finnegan has delivered for Innoscience in its dispute with Efficient Power Conversion Corporation (EPC) and reflects Finnegan’s aggressive, coordinated, and forward‑looking multi‑forum strategy to defeat EPC’s claims and protect Innoscience’s business.
First Win – ITC Investigation
In the ITC investigation initiated by EPC in May 2023, Finnegan successfully dismantled the majority of EPC’s case. The Finnegan team compelled EPC to withdraw two of the four asserted patents and secured a determination that a third patent was not infringed. As a result, EPC’s case was reduced to a single patent—U.S. Patent No. 8,350,294 (the ’294 patent)—and only two claims, on which the ITC issued the LEO.
Second Win – USPTO Invalidity Decision
But the ’294 patent was soon destroyed by Finnegan at the U.S. Patent and Trademark Office (USPTO). Exercising foresight and strategic vision, Finnegan filed an inter partes review (IPR) challenging the’294 patent early in the dispute. Just months after the ITC’s final determination, the USPTO issued a final written decision holding all claims of the ’294 patent invalid, eliminating the entire legal foundation of EPC’s remaining infringement allegations and delivering a timely, business‑critical victory for Innoscience.
Third Win – CBP Ruling
Although the LEO remains in place during the pendency of appeals of the ITC and IPR decisions, Finnegan moved swiftly to mitigate its business impact. Finnegan advised Innoscience to develop a new generation of GaN products that, under the ITC’s own infringement analysis, do not infringe the ’294 patent, and sought an administrative ruling from CBP confirming that these products fall outside the scope of the LEO. CBP’s February 20 decision confirmed Finnegan’s analysis and cleared the way for unrestricted U.S. imports and sales.
“This is a decisive win for Innoscience,” said Lionel Lavenue, Finnegan partner and lead counsel for Innoscience. “Through a deliberate and aggressive multi‑forum strategy, we defeated EPC’s claims piece by piece and delivered a result that protects Innoscience both legally and commercially.”
The CBP ruling ensures that Innoscience’s business is not disrupted by EPC’s claims and restores access to its high‑performance, cost‑effective GaN power solutions for U.S. customers, including in applications such as AI data centers, robotics, solar micro inverters, and EV onboard charging.
Appeals of both the ITC’s determination and the USPTO’s invalidity decision are underway. Finnegan expects additional favorable outcomes that will permanently resolve the remaining issues and eliminate the exclusion order in its entirety.
“This case shows what is possible when ITC litigation, USPTO proceedings, and CBP review are coordinated with a clear business objective,” Lionel added. “And this story on the many successes of Innoscience is not even over – there’s more to come.”
