Finnegan client BMW convinced a Virginia federal judge to dismiss its suit seeking a declaration that its Infineon integrated circuits did not infringe a patent held by Arigna. Additionally, U.S. District Judge Rossie Alston Jr. tossed the case with prejudice.
Finnegan’s counsel for BMW told Law360 that the car manufacturer was able to show in a declaratory judgment action that the patent was invalid due to prior art, causing Arigna to withdraw its patent infringement claims and promise not to sue BMW over the patent-in-suit again in the future.
"BMW Group is the only automaker that has refused to accede to Arigna's demands," said the Finnegan team.
