The top two Texas patent federal judges agreed to hold litigation between two automotive brands after Finnegan client BMW successfully convinced the patent board to review “every single claim” involved in litigation over decade-old wireless patents.
Finnegan partner, Lionel Lavenue told Law360 that the rulings that he's obtained at the board have put up for review "every single claim of every single NorthStar patent" that's involved in the litigation between the companies, which will give BMW the chance to pursue various legal attacks at the patent board on all the patents involved in those cases before they have a chance to reach a jury.
Lionel said that the litigation between the companies involves "more than 90 claims," which date as far back as an idea involving "route-based communication planning architecture" that was issued to a DaimlerChrysler engineer in the year 2000.
Additionally, Lionel said that "100% institution rates are not something that one sees often. We are thrilled that we achieved a perfect [result] — 6 favorable institution decisions for 5 patents across 6 different IPRs."
