Pvtech Secures Stay of New Jersey District Court Litigation Following USPTO Institution of All 10 Ex Parte Reexamination Requests Against Patents Asserted by Jiaxing Super Lighting

WASHINGTON, DC-Finnegan client Xiamen Pvtech Corporation (“Pvtech”) announced today that Chief Judge Renee Marie Bumb of the U.S. District Court for the District of New Jersey has granted Pvtech’s motion to stay the ongoing patent litigation filed by Jiaxing Super Lighting Electric Appliance Co., Ltd. (“Super Lighting”) and its affiliate Obert, Inc. (“Obert”). The stay follows the United States Patent and Trademark Office’s (USPTO) institution of all ten ex parte reexamination (EPR) requests filed by Pvtech against the ten patents asserted in the case.

Pvtech filed its motion to stay on January 9, 2026, after submitting an EPR request on one of the asserted patents and announcing that requests against the remaining nine patents would follow shortly. By January 26, 2026, Pvtech had filed all ten requests. As each request was granted, Pvtech promptly notified the District Court, updating the status and the percentage of claims under reexamination. On April 21, 2026, the USPTO instituted the final reexaminations, and on April 24, 2026, Chief Judge Bumb issued an opinion and order granting the stay, finding it appropriate given the early stage of the litigation.

In 78% of ex parte reexamination proceedings, the USPTO either cancels all claims or issues a reexamination certificate with amended claims. In this matter, Pvtech challenged all 420 claims across the ten patents—not merely the 72 claims currently asserted by Super Lighting. With the case now stayed, the District Court litigation is poised to resume with a significantly narrowed scope of patents and claims, greatly simplifying the issues for trial and strengthening Pvtech’s position.

“Pvtech will continue to vigorously defend its rights and press Super Lighting to compete freely in the market rather than through needless litigation over invalid and improperly asserted patents,” said Lionel Lavenue, lead counsel for Pvtech.
