The Federal Circuit revived Babatunde Oguntade’s whistleblower complaint, finding that the Merit Systems Protection Board has jurisdiction to consider his allegations that the Department of Veterans Affairs retaliated against him after he raised concerns about an AI tool used to process disability claims. The court found that Oguntade sufficiently alleged gross mismanagement, allowing his whistleblower claim to move forward.
Finnegan attorney Alexander Harding, who argued the case told The National Law Journal that, “It has been a privilege to represent Dr. Oguntade, and we are delighted to have secured this important victory allowing him to move forward with his whistleblower claim.”
