On May 9, 2022, the Patent Trial and Appeal Board (PTAB) ruled in favor of Finnegan client BMW of North America LLC in an inter partes review (IPR) proceeding challenging a patent held by Omega Patents LLC concerning a remote control start system for cars. The PTAB ruled the patent invalid after BMW proved all 31 claims are obvious in light of several combinations of prior art. Omega asserted the patent at issue against BMW in the Northern District of Georgia, but the case was transferred to the District of Delaware, where it is stayed pending the PTAB’s decision. Finnegan attorneys Lionel Lavenue, Kara Specht, Kai Rajan, and Ben Cassady represented BMW.
