Finnegan client Incyte prevailed over Sun Pharmaceuticals Industries and was granted a preliminary injunction preventing Sun from launching a product for treating hair loss in the United States.
In July, the FDA gave Sun approval to sell its product, which is a competitor to Incyte's Olumiant hair loss drug. However, Incyte licensed the underlying intellectual property of Olumiant to Eli Lilly and continues to earn substantial royalties for its sales.
Finnegan partner Mark Feldstein served as lead counsel for Incyte. He said, "We appreciate the court's time in carefully considering Incyte's injunction request, and we are happy that the court decided to uphold Incyte's intellectual property rights at this stage."
