The arrival of the Unified Patent Court (UPC), scheduled for early 2023, will impact patent litigation in Germany. To prepare, German firms are looking to expand their patent litigation teams and related legal support. Managing Intellectual Property interviewed Antje Brambrink for insight into how Finnegan’s Munich office is being proactive in putting the proper support in place ahead of the UPC.
Antje said, “A lot of firms have stocked up their teams, including us with our Munich office. A new associate will join us later this year, and we are interviewing more candidates as well.”
While infringement and nullity claims are handled by different courts under German law, and usually by either litigators or patent attorneys, the UPC will hear both issues together. This could impact firms that focus on one aspect or the other. Antje notes that the presence of several dual-qualified litigators and patent attorneys is an advantage for Finnegan.
