On July 22, 2015, the Federal Circuit ruled in favor of Finnegan client Posco, vacating a lower court's ruling that modified a protective order allowing foreign courts to access Posco's proprietary information. The lower court cited the Pansy ruling in its decision, however, the Federal Circuit concluded that the court did not correctly interpret the ruling and should have taken other provisions into consideration. Posco's petition for writ of mandamus was granted by the Federal Circuit and remanded to district court. The dispute began in 2012 when Nippon Steel sued Posco for patent infringement and trade secret theft.
