In the Western District of Texas, Judge Alan Albright issued a final opinion reinforcing that disputes over U.S. patents must be resolved in U.S. courts, explaining his decision to block Onesta IP from pursuing parallel infringement litigation against Finnegan client, BMW, in Germany. He emphasized that the Munich action threatened U.S. policy interests, including jury rights and access to key procedural protections available only in American courts.
Finnegan partner Lionel M. Lavenue, counsel for BMW, welcomed the ruling, stating, “Both Finnegan and BMW are extremely pleased with this well-reasoned ruling. This decision safeguards the integrity of the U.S. patent system, protects BMW's right to a full and fair defense in the proper forum for disputes over U.S. patents, and prevents improper attempts to circumvent American judicial processes.”
