Finding Litigation Misconduct in Patent Suit, Judge Awards Costs and Fees

Federal Judge Claudia Wilken ordered O2 Micro International Limited to pay $339,000 in costs and potentially millions in attorneys fees after finding that the company engaged in litigation misconduct during a series of patent suits with Monolithic Power Systems Inc (MPS). The judge ruled that  O2 Micro had engaged in “vexatious litigation strategy” against MPS, who is represented by Finnegan. The two companies have engaged in a series of legal disputes since 2001. “We have always felt somewhat persecuted as a result of the approach O2 Micro had,” said Scott Mosko, partner at Finnegan. “I think Judge Wilken saw the inappropriate actions and the activities that were occurring by O2 Micro and called them for what they were.”
