On February 2, 2017, a Delaware judge ruled in favor of Finnegan client AstraZeneca, confirming that its patents covering diabetes drugs were not invalid for being obvious.
In 2014, AstraZeneca filed separate complaints against generic drug makers Wockhardt BIO AG, Mylan Pharmaceuticals, and Amneal Pharmaceuticals, asserting infringement of its diabetes patent after the drug makers filed abbreviated new drug applications seeking approval for generic versions of AstraZeneca's drugs Onglyza and Kombiglyze XR. The generic drug makers' applications stated that their versions either would not infringe AstraZeneca's patent or that the patent was invalid. AstraZeneca then sued for infringement under the Hatch-Waxman Act.
