The U.S. Patent and Trademark Office (USPTO) has upheld the i4i LP patent at the center of a lawsuit with Microsoft Corp., finding all the challenged claims patentable. “The USPTO issued a re-examination certificate Tuesday confirming the patentability of U.S. Patent Number 5,787,449, marking an end to the re-examination process Microsoft initiated after being sued by i4i in 2007,” i4i said. Toronto-based i4i sued Microsoft in the U.S. District Court for the Eastern District of Texas in March 2007, claiming that the defendant incorporated technology claimed in the '449 patent into its Word software. On Aug. 11, after a jury trial, Judge Leonard Davis awarded i4i $290 million in damages and banned sales of the allegedly infringing Word software. Finnegan represented i4i in the courts.
