Finnegan client Under Armour secured a victory in a high-profile trademark case in China against Uncle Martian, a Chinese company that infringed Under Armour's trademark rights by selling athletic wear that featured a logo similar to Under Armour's. The court ordered Uncle Martian to pay Under Armour US$300,000 (RMB 2,000,000) in damages and to destroy and permanently stop using the contested trademarks.
The trademark dispute began in 2016 when Uncle Martian launched its apparel brand. Under Armour took legal action, seeking a preliminary injunction and monetary damages in a Chinese court. The Chinese court granted the preliminary injunction in November 2016, and issued a final ruling in June 2017.
