On November 17, the Patent Trial and Appeal Board (PTAB) reversed its decision to deny SharkNinja’s request for an inter partes review (IPR) of an iRobot Corp. patent related to automated docking and charging elements for robotic floor cleaners. The board admitted it had erred in its initial assessment of the final determination date for a related U.S. International Trade Commission (ITC) investigation, thus changing its analysis of the second Fintiv factor. Additionally, SharkNinja broadened a stipulation stating it would not duplicate invalidity arguments at the ITC that were raised at the PTAB.
