Between the COVID induced shortage of semiconductor chips, the CHIPS and Science Act passed by Congress in July 2022 to boost semiconductor R&D and manufacturing in the United States, and the importance of software and technology to many businesses, the semiconductor industry is facing several challenges that are impacting intellectual property strategies. Managing Intellectual Property interviewed Finnegan partner J.P. Long for his insight.
When faced with proceedings before the U.S. International Trade Commission (ITC), some companies are using supply chain issues resulting from the pandemic to their advantage. J.P. says when there is a shortage, it is easier for respondents’ counsel to argue that exclusion orders go against the public interest.
