Finnegan achieved a significant win before the Patent Trial and Appeal Board (PTAB) for client TriTech Software Systems, owned by CentralSquare Technologies. In a rare move, USPTO Director John Squires reversed an instituted inter partes review (IPR) filed by Carbyne Inc., finding that the petitioner advanced inconsistent claim- construction positions in district court and at the PTAB. The reversal fully halts the IPR proceeding challenging TriTech’s emergency communications patent.
Finnegan partner and counsel for CentralSquare, Lionel Lavenue, said in a statement that the "decision not only halts this IPR challenge entirely but also compels Carbyne to rethink its overall strategy in the ongoing district court litigation and beyond." He further noted, "We are proud to have secured this outcome for CentralSquare, allowing the company to continue focusing on delivering mission-critical public safety solutions without unwarranted disruption."
