Semiconductor patents are gaining popularity globally, however, in-house counsel are experiencing challenges with enforcement and detecting infringement.
Some practitioners believe that the rise in semiconductor patenting will lead to more non-practicing entity (NPE) litigation and licensing. Finnegan partner, J. Preston (J.P.) Long told Managing Intellectual Property that there’s a lot of consolidation in the industry, which leads to patents transferring hands. He also said there’s an incentive to monetize patents by transferring them to NPEs, sparking more disputes.
