Fed. Circ. Revives Drill Bit Patent ITC Found Abstract

The U.S. Court of Appeals for the Federal Circuit has reversed a ruling that US Synthetic Corp., had an invalid patent for a polycrystalline diamond compact (PDC), a compound crucial to diamond drill bits. Previously, the U.S. International Trade Commission (ITC) invalidated the patent, claiming it did not meet eligibility standards.

A three-judge panel reversed the invalidation and said the ITC's analysis did not adhere to the Supreme Court's two-step Alice test. The court’s opinion clarified that the claimed PDC was not an abstract idea but a specific composition of matter, thus satisfying patent eligibility requirements. The case has been remanded for further proceedings, enabling US Synthetic to pursue its original objective of banning competitor imports.
