The Pennsylvania State University recently won a highly publicized case against Vintage Brands, a retailer that infringed its trademarks. The retailer is no stranger to trademark infringement claims; however, this is the first time that a university sued them and went to trial.
When asked what this ruling could mean for brands, Finnegan partner Mark Sommers told Managing Intellectual Property that he doesn’t believe this ruling would make him more likely to advise clients to sue, noting that the firm already advises clients in enforcing their rights.
He noted, however, that if the court had ruled the other way – he would have had to factor those findings into his strategy.
