Patent Term Extension (PTE) and Supplementary Protection Certificate (SPC)

About

Strategically extending patent protection
If your patented innovation will be developed into a product subject to regulatory approval, such as a human or veterinary pharmaceutical, medical device, food additive, or herbicide, the patent life can be extended through Patent Term Extension (PTE) in the United States or Supplementary Protection Certificate (SPC) in many European jurisdictions, as well as others around the world. These extensions, which can provide additional years of patent protection to crucial innovative products, represent one of the most commercially valuable strategic tools for regulated products.

Advanced planning and calculated timing are critical for positioning patents to meet the eligibility requirements. Finnegan attorneys are highly experienced in working with clients to take advantage of the available extensions. The international nature of Finnegan means that, where applicable, we can coordinate PTE and SPC filings. Our patent professionals are on hand to keep you up to date with the latest decisions and developments as well as advise on the most effective national and global filing strategies.
