Winning Global IP Disputes: Litigation, SEP, and FRAND Strategies

As patent disputes become increasingly global, companies must navigate litigation and licensing issues across multiple jurisdictions while maintaining consistent legal and commercial positions. Developments in U.S. patent litigation, the growing role of the Unified Patent Court and German courts, and intensifying competition among jurisdictions in standard-essential patent (SEP) and FRAND disputes have created both new risks and strategic opportunities for businesses operating internationally.

This seminar will examine how companies can develop coordinated strategies for complex, multijurisdictional patent disputes. Finnegan attorneys from the United States, Germany, and the United Kingdom will discuss recent developments in U.S. patent litigation, the strategic use of U.S. discovery in support of international proceedings, the negotiation and drafting of SEP licenses, and effective patent enforcement strategies before the Unified Patent Court and German courts. The program will also explore the increasingly influential role of the English courts in setting global FRAND terms and shaping parallel SEP proceedings.

Drawing on recent developments and practical experience across key jurisdictions, the speakers will offer insights into managing cross-border litigation, strengthening licensing positions, and using procedural and jurisdictional differences to support a coordinated global dispute strategy.

Topics to be discussed include:

  • The U.S. Litigation Landscape
  • Negotiating and Drafting SEP Licenses: From FRAND Principles to Contract Language
  • Winning Strategies for Patent Litigation before the UPC and German Courts
  • The UK Advantage: Shaping Global SEP and FRAND Disputes
