We are pleased to announce that Finnegan will be hosting an in-person seminar in Tokyo and Osaka exploring the latest developments in European and U.S. patent practice, with a focus on the life sciences and chemical industries. The seminar will provide practical insights into the following topics:

  • Navigating Europe’s Patent Landscape: The EPO, Germany, the UK, and the UPC: A practical guide to opposition proceedings at the EPO and patent litigation before the German and UK courts and the Unified Patent Court (UPC), including forum strategy for life sciences companies.
  • The Inventive Step Divide: Assessing Obviousness Across Five Jurisdictions: A comparative analysis of how the EPO’s problem-solution approach, the UK’s Windsurfing/Pozzoli test, the German approach, emerging UPC Court of Appeal jurisprudence, and U.S. obviousness standards apply to life sciences inventions.
  • Proving Your Patent: Sufficiency, Plausibility, and Written Description/Enablement: How disclosure requirements are diverging after the EPO Enlarged Board’s decision of G 2/21 – exploring plausibility and sufficiency thresholds in the UK, EPO, Germany and the UPC, and the written description/enablement doctrines in the U.S.
  • From Strategy to Outcome: Lessons from European and U.S. Patent Enforcement: A practical discussion drawing on real-world enforcement experience in Europe and the U.S., including strategic considerations for selecting forums, coordinating parallel proceedings, developing evidence, managing litigation risk and achieving business-oriented outcomes in life sciences and chemical patent disputes.
