Almost three years since the launch of the UPC on 1 June 2023, and we are witnessing an increasing number of decisions. Among these decisions is an initial wave in which the doctrine of equivalents is addressed. Local Divisions of the UPC have ruled on the doctrine of equivalents, but so far no consolidated approach has been set by the UPC’s Court of Appeals.
When litigating patents before the UPC, it is crucial to understand the standards for the doctrine of equivalents applied by the UPC and what extent these standards diverge from the national courts. Equally important are any differences in procedural rules applied in proceedings before the UPC and national courts.
Based on the UPC case law available in the first three years, this seminar will analyze select UPC decisions on the doctrine of equivalents, elucidating the differences and similarities between the approaches of the UPC’s Local Divisions and the practice of the national courts of the UPC member states and the UK.
