The Trademark Trial and Appeal Board (TTAB) denied California-based restaurant Jack’s Grill and Billiards Inc.’s attempt to register its name, citing the likelihood of confusion with Finnegan’s client, Jack’s Family restaurants, which has hundreds of locations in Alabama, Georgia, Mississippi, and Tennessee.
The TTAB sustained Jack’s Family Restaurants’ opposition to Jack’s Grill and Billiards registration bid since they’ve been in operation since 1960 and have a strong brand.
Finnegan partner Chip Rettew told Law360 that, “We are very pleased that the Trademark Trial and Appeal Board once again recognized the scope of protection due to our client's iconic JACK'S trademark, whose roots date back 65 years.”
