When trying to land Trademark Trial and Appeal Board (TTAB) work, some attorneys say that monitoring the USPTO trademark register can be fruitful. By utilizing a third-party technology vendor that searches registers for potentially infringing marks, law firms can be prepared when a trademark application comes too close to a client’s registered mark.
Finnegan partner Naresh Kilaru told Managing Intellectual Property that, “Once we’ve become aware of a potentially conflicting mark through one of these watch services, that’s typically how that can evolve into an opposition proceeding.”
According to Naresh, referrals also help secure work. He said he would pitch his firm’s “deep bench” of litigation expertise and draw upon its district court litigators, who also do TTAB cases, if he was trying to get work from a new client.
“When we pitch for cases, we tend to delve into the specifics of a particular case and develop a strategy specific to that case to give them an idea of what their best claims are.”
