The Cleveland Major League Baseball team and Guardians Roller Derby team reached an “amicable resolution” following a trademark infringement lawsuit over the ‘Guardians’ name and logo. Details regarding the settlement were not public, but both parties will be allowed to use the “Guardians” name moving forward. Law360 interviewed Finnegan partner Mark Sommers for his thoughts on the case.
Mark stated: “It wouldn’t surprise me if there were some sort of negotiations around colors or elements of the logos to make sure they are distinguishable visually…That will have to manifest itself in the marketplace.”
