On March 5, Baxter International Inc. filed a petition for certiorari asking the U.S. Supreme Court to review a Federal Circuit decision involving cancellation of a dialysis machine patent. The filing follows a split decision at the Federal Circuit and a denied request for rehearing. Finnegan partner James R. Barney provided comment on the petition to the Supreme Court, “I think it’s a strong candidate for the court to take,” he said. “The en banc court split dramatically and the dissent uses language flagging this as an important constitutional issue.”
