Post-grant proceedings have quickly become one of the most popular tools for challenging a patent while maintaining low costs. But navigating the law of this new arena can be challenging. With the small body of PTAB decisions starting to grow and the Federal Circuit beginning to review PTAB decisions, now is the time to identify key strategies that have proven useful.
With significant experience in post-grant proceedings, this panel will help you navigate the phases of these proceedings, from petition to oral hearing. Each stage of the process offers opportunities and landmines for both the patent owner and the petitioner. We will help you identify and prepare for these issues before the petition is even filed.
