Jason Romrell—former leader of Finnegan’s appeals, issues, and legal strategy section— helps companies navigate high-stakes intellectual property disputes at both the trial and appellate levels. He represents clients before federal district courts, the Patent Trial and Appeal Board (PTAB), and the U.S. Court of Appeals for the Federal Circuit. He has drafted numerous appeal briefs and regularly argues before the Federal Circuit. Jason uses his experience as a district court law clerk and a Federal Circuit law clerk to support clients in formulating winning strategies at each stage of litigation.

Jason is well-versed in all aspects of patent litigation, including discovery, depositions, claim construction, summary judgment, oral argument, and examining witnesses at trial. Beyond his own trial experience, Jason frequently assists trial teams within and outside of Finnegan as an embedded appellate practitioner and brief writer. He provides valuable guidance in perfecting the record for appeal and handles motions in limine, jury instructions, charge conferences, and mid-trial motions. After trial, Jason manages post-trial briefing and transitions the case to appeal. He has extensive know-how litigating patent damages and Daubert challenges before district courts and the Federal Circuit.  

 

Jason has experience in a wide array of industries, including pharmaceuticals, medical devices, software, mobile phones, semiconductors, process engineering, and consumer products. Jason is a former R&D engineer at a large medical device company, where he designed and tested advanced drug delivery technology and manufacturing processes.

 

Jason has lectured in the United States and internationally on patent damages, patentable subject matter, and Federal Circuit jurisprudence. He represents parties before the Federal Circuit on a pro bono basis, including parties appealing from the Merit Systems Protection Board (MSPB). Prior to joining Finnegan, Jason served as a judicial law clerk to the Honorable Sharon Prost at the Federal Circuit and to the Honorable Ronald M. Whyte at the U.S. District Court for the Northern District of California. 

 

 

Experience

Promptu Systems Corporation v. Comcast Corporation

Obtained a $240 million jury verdict for client Promptu in a patent infringement lawsuit against Comcast. The jury found that Comcast willfully infringed Promptu’s patents covering voice recognition technology for TV.

Incyte Corporation et al. v. Sun Pharmaceutical Industries Limited et al.

Successfully represented Incyte in patent litigation, including preliminary injunction proceedings related to Sun Pharmaceuticals’ deuterated Janus kinase (JAK) inhibitor, LEQSELVI™. Case settled favorably for our client.

Incyte Corp. v. Concert Pharmaceuticals, Inc.

In a rare rehearing proceeding, successfully represented petitioner Incyte in an inter partes review (IPR) challenging the validity of Concert’s patent before the Patent Trial and Appeal Board (PTAB). Continued representation of appellee Incyte before the Federal Circuit and secured a unanimous affirmance of the PTAB’s obviousness determination.

Hawk Technology Systems, LLC v. Castle Retail, LLC

Represents Castle Retail in patent litigation brought by Hawk Technology Systems in district court and on appeal. The district court ruled in Castle Retail’s favor, granting Castle Retail’s Rule 12 motion and invalidating Hawk’s patent claims related to video surveillance technology. On appeal the Federal Circuit affirmed the district court ruling. The district court then granted our client more than $106k in attorneys fees, finding the entirety of Finnegan’s attorneys fees to be reasonable.

Risen (Suzhou) Pharma Tech Co., Ltd. v. Alzheon, Inc.

Successfully represented Alzheon, Inc. before the Patent Trial and Appeal Board (PTAB) in securing denial of petitions for inter partes reviews (IPR) and post-grant review (PGR) challenging two of Alzheon’s patents related to ALZ-801/valitramiprosate, a treatment for Alzheimer’s Disease. Also successfully represented Alzheon before the Federal Circuit in an appeal related to isotopically enriched forms of ALZ-801/valitramiprosate.

Genzyme Corp. v. CSRC et al.

Represented CSRC in two arbitrations and one litigation relating to exclusive licenses and patent assignments for patents directed to treating Pompe Disease, a rare genetic disorder that is often fatal if untreated. Secured a $180 million settlement from Genzyme.
