Secured an en banc Federal Circuit victory for a disabled veteran, overruling prior precedent that excluded current federal employees from the Veterans Employment Opportunities Act’s right-to-compete protections. The court held that federal agencies may not deny covered veterans the opportunity to compete for merit-promotion vacancies merely because they already work for the federal government, vacated the MSPB’s decision, and remanded for further proceedings.
