Finnegan attorney Daniel G. Chung was recently named as the Inaugural Future Litigation & Risk Management Scholar by The Sports and Fitness Industry Association (SFIA). The SFIA states that “Daniel is more than worthy of being the SFIA’s first Future Litigation & Risk Management Scholar” noting his experience and highlighting his thoughts on the most impactful legal issue threatening the sports and fitness industry within the next five years. Chung notes that from an intellectual property perspective he anticipates an increase in patent litigation in the fitness wearables space. And that “these attacks may cover both the way wearables look – via design patents – and the way wearables work – via utility patents.” In an effort to protect itself from this risk Chung states, “…companies should understand the wearables patent landscape, including the protected scope of rights and the entities holding those rights. This analysis will identify what technology is covered and by whom, ultimately providing an assessment of a company’s risk and exposure.”
