The Court of Appeals for the Federal Circuit ruled favorably for Finnegan client Nestlé USA in three appeals from inter partes review (IPR) decisions by the Patent Trial and Appeal Board (PTAB). In each IPR, Finnegan challenged the patentability of claims from patents asserted against Nestlé USA in a related patent infringement suit. The PTAB upheld the patentability of challenged claims from two of the patents, so Finnegan appealed to the Federal Circuit. In the appeal, the Federal Circuit vacated the decisions and remanded the cases, ruling that the PTAB adopted erroneous claim constructions. In the third IPR, the PTAB found all the challenged claims unpatentable. Finnegan defended that decision on appeal, which the Federal Circuit affirmed.
