The assessment of patent validity may vary significantly from country to country. When litigating patents, it is therefore crucial to understand the different standards for claim construction, inventive step, and sufficiency of disclosure applied by the various courts and patent offices in Europe and the United States.
Rainer Engels, former Presiding Judge of the 4th Nullity Senate at the Federal Patent Court, has significant experience in trademark and patent law in the fields of chemistry, mechanical engineering, and electrical engineering. He will present different approaches to dealing with validity issues applied by German courts versus the EPO. Finnegan speakers will add the U.S. perspective.
