Much has been written about the Unified Patent Court (UPC) since its launch on June 1, 2023. Many litigants have taken a cautionary approach, while others have made use of the strategic opportunities that this new venue provides. In this new forum, there are still many questions about the interpretation of the regulations and the implementation of available UPC procedures and remedies. However, with careful planning and experienced counsel, the UPC has clear advantages and will be paramount to resolving European and global patent disputes.
