The AmLaw Litigation Daily named Finnegan attorneys Douglas “Chip” Rettew, Patrick Rodgers, Laura Masurovsky and Rosie Norwood-Kelly Litigators of the Week for their jury-trial win for client Under Armour. A federal jury in Baltimore ruled that Armornia, a startup that makes athleticwear for women, infringed and diluted Under Armour’s “Armour” trademarks. By only seeking a $1 in damages, Under Armour demonstrated its desire to not put the defendant out of business, but rather protect its trademark rights.
In this interview, Doug discusses the strategy behind the win and how the team addressed the “David and Goliath” concern. He said, “With any disparity in resources or size, there’s always a concern that jurors will reflexively think “David and Goliath” and favor the smaller party—even if subconsciously. We dealt with this several ways.”
