Southern District of Texas Judge Lee H. Rosenthal ruled that the case brought against Finnegan client Volkswagen by VDPP LLC was "exceptional," holding VDPP and its counsel, Ramey LLP, jointly and severally liable for attorney fees. The court quantified the award at $207,543.60 and rejected VDPP’s request to allocate fees between frivolous and nonfrivolous aspects of the case, stating, "It was all frivolous."
