Finnegan client Fox Factory received a favorable decision from the U.S. Court of Appeals for the Federal Circuit on December 18, 2019. The court vacated a Patent Trial and Appeal Board (PTAB) decision that upheld a bicycle chain ring patent owned by SRAM, ruling that SRAM’s evidence claiming its product was successful and received industry praise does not imply that the patent was not obvious, since the evidence is not tied to features of the patent itself. Upon vacating the PTAB’s decision, the Federal Circuit stated that SRAM will have the burden of showing that the success of its patent is attributed to the features in the patent.
