WASHINGTON, DC—In two decisions handed down on April 22, 2022, a three-judge panel of the Patent Trial and Appeal Board (PTAB) refused ScentAir Technologies, Inc.’s request to find all claims unpatentable in a pair of Prolitec, Inc. patents covering leak-proof cartridges for scent diffusion systems. A Prolitec lawsuit pending in Delaware alleges that ScentAir infringes both patents.
“This result is a significant victory for Prolitec,” said Finnegan partner Cory C. Bell, who represented Prolitec. When the non-instituted petition on U.S. Patent No. 9,480,767 is also considered, “43 of Prolitec’s original claims have survived the PTAB process.”
At issue in the April 22nd decisions are U.S. Patent Nos. 9,162,004 and 9,745,976. While the PTAB panel found some claims unpatentable, it held that 15 claims in the ’004 patent and 9 claims in ’976 patent had not been shown to be unpatentable.
