On October 25, Fidelity National Information Services, Inc. filed petitions to the Patent Trial and Appeal Board (PTAB) requesting review of the Ballard patents, a pair of check-imaging patents held by DataTreasury Corp. The patents are “widely seen as the impetus for shaping the America Invents Act’s business method review program.” Finnegan partner Darren M. Jiron told Law360, “These patents are the two that were identified by name when the predecessor to Section 18 was being discussed and they became the seed that started all of this.” Finnegan represents Fidelity in this matter.
