U.S. Customs and Border Protection (CBP) ruled in favor of Finnegan client Vilox Sweden AB, determining that its licensees' vinyl floor panels do not infringe Mohawk Industries Inc. patents and can be imported into the U.S. This decision comes after a 2020 U.S. International Trade Commission (ITC) general exclusion order that barred imports of floor tiles infringing Mohawk patents. Although Vilox was not involved in the ITC case, its licensees’ products were initially affected by the ban. CBP has now confirmed that Vilox met the burden of proof to show that its licensees’ products are not subject to the exclusion order.
